Homosexual couples should have the right to be married as well

With the Centre saying Delhi High Court that a marriage is between biological man and biological woman, it raises yet another question- why cannot gay and lesbian couples marry?

Back in February of probably this year, Centre, seeking dismissal of petition of legalization of homosexual marriages, argued that a marriage in India necessarily depends upon 'age-old customs, rituals, practices, cultural ethos and societal values' and that living together as partners and having a sexual relationship by same-sex individuals is "not comparable" with the "Indian family unit concept" of  a husband, wife and children. Well, when it comes to age old traditions of India, here is a video by Dr.Tanaya Narendra (aka DrCuterus) about the progressive culture of ancient India when it came to homosexuality and other things.

India had been very progressive about homosexuality before Britishers colonised India and passed Section 377 to criminalize gay marriages. 

Netherlands was the first country to legalize homosexual marriage, back in 2001. When they can do it, way back in 2001, surely can India legalize same-sex marriage, especially with the LGBTQIA+ and sex positivity history we had in ancient India (before Manusmriti came into existence). 

Yes, ofcourse, LBTQIA+ couples cannot have biological child together as a couple. But having a child or not does not necessarily define a family. They can go via IVF, donor egg/sperm, surrogacy or adoption to have a child. A homosexual individual can opt for any of the 4 above options to have a child,an an individual. This happens in western countries (where homosexual marriages are legalized) and can happen in India too once homosexual marriages is legalized in India and homosexual couple can have child the way they both mutually agree to.

It has been 3 years since homosexual relationships has been legalized in India. Now I think is the step that even homosexual marriages gets accepted in India.

It is said that final hearing on this topic is on 30 November 2021, which already has 5 petitions to legalize same-sex marriages. I hope, as a LBTQ+ ally, that homosexual marriages gets legalized in India very soon.
